Enclosed are my final comments with attorney Dennis Serna from Prudent Law Group. I would like to say that this is not a “fee dispute”; I have no problem with paying a fee if services are rendered. I also understand that there is no guarantee of an outcome in terms of rates or workout options. My main contention is that little or no effort was made on my behalf to negotiate with my lender Chase Bank. There were no REAL negotiations taking place with my lender other than one phone call to a customer service representative to obtain a quote for a HARP loan. Although the firm holds themselves out to be a law firm no lawyer represented me, only no licensed individuals. I was sent a misleading advertising flyer with no return address. It looked very official as if it came from my bank.
1. I was told I could qualify for a HAMP loan (2%) and that I could expect to save between $580 and $720 per month on my new loan modification.
2. They asked for an upfront fee of $3,495.00
3. Was told by Mr. Gill Penhollow never to speak with my lender if they should call or write.
4. Two months went by without any status update.
5. I kept calling Prudent Law and I finally was told that Mr. Dennis Serna would be my attorney.
6. From February 2012 to June 2012 I kept trying to talk to Mr. Dennis Serna and get some type of information but I was always told the same, that my bank would like more and more documents.
7. Chase started to call me in April 2012 and I emailed Mr. Dennis Serna many times saying my bank was trying to communicate with me but since I was told not to talk to them I let Mr. Dennis Serna handle it.
8. I finally decided to investigate what was happening. I spoke with Chase on July 18, 2012 and they said my case was closed on May 21st, 2012 due to lack of documents. They said they never received my P&L statement. And since it was closed I’d have to start from scratch.
9. I've contacted Mr. Dennis Serna regarding this notice on same day I spoke with Chase asking for an explanation and all he said was that the case was not closed and that he would put us on a conference call. I told him since Prudent Law was not able to do as promised, I requested the refund of my money. He simply said would give me a call back and I never heard from him since. It’s been a month.
