I'm another victim of One West Bank. They are HORRIBLE!!! I've been trying to modify with them since Dec 2008. My husband is in sales and his income dropped dramatically since the economy went down. We sent them a letter that we were having trouble making the mortgage payments. (Prior to that we never missed a payment). After a year of resending all the documents, phone calls, lies, no responses, we had an auction date for Oct 16, 2009. We did not know until we called the day before. They said that although we were still in modification process they could not stop the auction date. We might still be modified by not have a home anymore. Huh??? We had no other option than to file an emergency BK to save our home. Funny thing is 2 weeks after the BK, they FINALLY sent a letter stating we did not qualify since we filed a BK.
So, we are attempting to start the modification process again, since husband cannot get out of the sales industry. We've sent all documents, and it seems like it's starting all over again. They keep saying certain docs are missing. This is very frustrating. We do not want to just 'walk away'. We know this is our responsibility. We had put $110,000 down on this home and lost it all. The house is worth less than half of what we purchased it for, so refinancing is no longer an option.
Something needs to be done. We cannot afford an attorney. I've filed with the BBB. What else needs to be done? Help!!
